You acknowledge and agree that we: (i) do not own or operate aircraft; (ii) act exclusively for you, the charterer; (iii) are an air charter broker operating under 14 CFR Part 295 as an indirect air carrier and will contract transportation services with FAR Part 135 Direct Air Carriers or their foreign Civil Authority (CAA) equivalent that operate and exercise full operational control over those flights at all times; and (iv) do not maintain liability insurance for any aircraft. At your request, Incentive Jet may have the operator add your, your passengers, and/or your company listed as additional insureds on the operator's aircraft liability policy.
TO THE FULLEST EXTENT PERMITTED BY LAW, INCENTIVE JET, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including if we believe you have violated these Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Chicago, Illinois. You agree to submit to the personal jurisdiction of those courts.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not waive that right. We reserve the right to modify or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Site is unavailable at any time or for any period. These Terms constitute the entire agreement between you and Incentive Jet regarding the Site.
